1. Who We Are


Create The Space (CTS) is a community platform connecting wellness practitioners, community organizations, and the individuals who find them. We operate a physical wellness space in Oakland (3851 Market Street) with digital access through the Community Hub Spot app.


We are a connector. We are not a healthcare provider, clinical services organization, or licensed medical referral network. That distinction matters — and we mean it. See Section 7.




2. Who Can Use CTS


You must be at least 13 years old to create an account. By using CTS, you confirm you meet this requirement and that the information you provide is accurate.


One account per person. You are responsible for keeping your login credentials secure and for all activity that happens under your account. If you suspect unauthorized access, contact us immediately at team@cr8thespace.com.




3. Membership Tiers and Billing


CTS offers the following membership tiers, billed monthly through Stripe:

Subscriptions auto-renew monthly. You can cancel anytime through the in-app billing portal or by contacting us. Cancellations take effect at the end of the current billing period.


Refunds: We do not issue refunds for partial months. If you believe you were charged in error, contact us within 48 hours of the charge and we will review it in good faith.


Concierge tier includes physical space key access at 3851 Market Street, Oakland. See Section 9 for details.




4. The Marketplace


Practitioners can list their services on the CTS marketplace. Purchases are processed through Stripe Checkout.


A few things to know:


  • CTS charges a 10% platform fee on each marketplace transaction.
  • CTS is a platform intermediary — we are not a party to the service agreement between a practitioner and their client. That relationship is between them.
  • Chargebacks and payment disputes are handled according to Stripe's standard policies. We will cooperate in good faith with any legitimate dispute process.

  • Practitioners: by listing on the marketplace, you represent that your credentials, qualifications, and service descriptions are accurate and not misleading.




    5. Acceptable Use


    CTS is built on trust. The following are not allowed on the platform:


  • Impersonation or false credentials. Do not misrepresent who you are or what you are qualified to do.
  • Medical advice or clinical content. No diagnoses, treatment recommendations, or prescription guidance — in posts, messages, listings, or live sessions.
  • Harassment, hate speech, or discrimination. Based on race, ethnicity, gender, religion, disability, sexual orientation, or any other protected characteristic.
  • Spam or unsolicited solicitation. Do not use CTS to recruit members for competing platforms or flood channels with promotional content.
  • Sharing others' private information without their consent.
  • Any content involving minors in an inappropriate context.
  • Misrepresenting CTS as a co-provider, clinical endorser, or referral source.

  • Violations may result in content removal, account suspension, or permanent termination. We will give notice where practicable. For safety incidents, we may act immediately.




    6. Your Content


    You own what you post — your content, your photos, your practitioner listings. By posting to CTS, you grant us a non-exclusive, royalty-free license to display and distribute that content within the platform for as long as your account is active.


    We do not claim ownership of your practitioner listings or business content. We may remove content that violates these terms or community guidelines — we will not do so arbitrarily.


    If you delete your account, your public content may persist briefly in cached or archived form before being removed. Private messages are subject to our data retention policies.




    7. Peer Model Disclaimer


    This section is important. Please read it.


    CTS is a connector and community platform. We bring practitioners, organizations, and community members together. That is what we do.


    CTS is not:

  • A healthcare provider
  • A clinical services organization
  • A licensed medical referral network
  • An endorser or validator of any practitioner's clinical practice

  • Practitioners on CTS are independent. CTS does not supervise, vet for clinical competency, license, or endorse any practitioner's professional practice. We do not verify credentials beyond what practitioners self-report.


    Nothing on this platform constitutes medical advice, diagnosis, or treatment.


    If you find a practitioner through CTS and engage their services, that relationship is between you and them. CTS is not responsible for outcomes of that relationship.


    If you are experiencing a medical emergency, call 911.




    8. Live Sessions


    Live voice and video sessions on CTS are peer-to-peer community experiences. The peer model disclaimer in Section 7 applies fully. CTS does not monitor session content. One-to-one session content is private — CTS staff do not have visibility into it.


    Practitioners must acknowledge the peer model terms before hosting any live session. This is not optional.




    9. Physical Space Access (Concierge Tier)


    Concierge members receive key or fob access to our Oakland space at 3851 Market Street. Access is activated upon:


    1. Active Concierge subscription, and

    2. Execution of the Physical Space Waiver


    Access hours are communicated at time of activation. Keys and fobs must be returned when your Concierge subscription ends or your account is terminated. Unreturned hardware may be subject to a replacement fee.


    CTS is not responsible for personal property left in the space.




    10. Limitation of Liability


    We are honest about what we can and cannot be responsible for. CTS is not liable for:


  • Outcomes of practitioner-client relationships
  • The accuracy of third-party listings or service claims
  • The quality of marketplace transactions
  • Data loss resulting from force majeure, infrastructure failure beyond our control, or third-party service outages (Supabase, Stripe, etc.)

  • Our maximum liability to any individual user is the total amount you paid to CTS in the three months immediately before the claim arose. This cap applies to the fullest extent permitted by California law.


    Nothing in this section limits liability for gross negligence, fraud, or willful misconduct.




    11. Dispute Resolution


    California law governs these terms and any dispute arising from your use of CTS.


    If something goes wrong, we ask that you contact us first at team@cr8thespace.com and give us a genuine opportunity to resolve it. Most issues can be handled that way.


    If a dispute cannot be resolved informally and proceeds to litigation, the prevailing party is entitled to recover reasonable attorneys' fees and costs.




    12. Changes to These Terms


    We may update these terms from time to time. When we do, we will notify you at least 30 days before changes take effect — by email, in-app notice, or both. If you continue using CTS after the notice period, that means you accept the updated terms.


    If a change is material and you disagree with it, you can cancel your account before the change takes effect.




    13. Termination


    You can close your account at any time. We can suspend or terminate accounts that violate these terms, at our discretion. We will provide notice where we can. For serious safety violations, we may act without prior notice.


    Upon termination, your access to paid features ends immediately. We do not issue refunds for remaining subscription time unless the termination was our error.
